Queen's grandson barred from marrying a Catholic - calling Noah Feldman!

The UK Timesonline reports that the Queen’s grandson, Peter Phillips, 10th in line to the throne, based on the 1701 Act of Settlement could be disqualified from the line of succession if he marries his Roman Catholic fiancĂ© . Noah Feldman, this calls for an editorial!

  1. Actually, the Act of Settlement simply says that they lose their place in the line of succession if they do, not that they can't.

    However, the Royal Marriages Act of 1772 says that the monarch can bar the marriage of anyone in the Royal family if they are under 25. After 25, they simply need give notice to Parliament and the monarch can't do anything about it.

    Many people in the line of succession to the British throne have married Catholics. Perhaps the highest one on the list is Prince Michael of Kent.

    Actually, this law was (in part) at the root of the tzooris inflicted upon Prince Charles. He would have been quite happy to marry Camilla Parker Bowles, except that she was a Catholic and twice divorced. That would not go down well with the British public. So they found a 19 year old virgin from an old British Protestant nobility and thrust her into a life she was not prepared for. The rest is history.

  4. That's not true. Camilla is not a Catholic. She was married to a Catholic and her children were raised as Catholics -- but she herself is Anglican. If she were a Catholic, Charles would have already lost his place in line for the throne.

    The problem has to do with the fact that the Duchess of Cornwall is divorced (only once, not twice -- and her ex-husband is still alive) and the fact that, in the public's mind (whether it's justified or not), she's viewed as a major cause of the breakup between Charles and Diana.
