yarei m'aveiros b'yado

I must be missing something, but I do not understand the din that someone who davens slichos should serve as shat"z for the rest of the tefilos of the day because "ha'maschil b'mitzvah omrim lo gmor."   Why not say every day that whoever daven shacharis should serve as shat"z for the rest of the day because "ha'maschil b'mitzvah omrim lo gmor?"  Obviously we don't say that.  So why is there such a din by slichos?

Rashi quotes the view of R’ Yosi that the “ha’yarei v’rach ha’leivav” who is given a deferment from battle (20:8) is someone who is afraid because of the “aveiros b’yado.” Doesn’t the peshuto shel mikra fit much better with R’ Akiva’s view that we are speaking “k’mashma’o” (as Rashi writes) about someone who is simply afraid of going to war?  Why does R' Yosi think that's not the fear the pasuk is talking about?  

Sefas Emes: Of course the pasuk is speaking about someone who is afraid to go to war -- even R’ Yosi agrees that’s what the words mean. What R’ Yosi (and Rashi, by quoting him) is explaining is the cause of that fear -- where does it come from? Not from cowardice, but “mei’aveiros b’yado,” because the person is weighed down by aveiros.

Why is that such a bad thing? Isn’t yiras shamayim an ideal?

It could be that the key word here is “b’yado” – a person should not be narrowly focused on their own plight to the exclusion of everyone and everything else.

The Sefas Emes has a different approach, based on an explanation he has in a few places (posted here) as to how Sarah, when challenged by G-d, could deny laughing at the malach’s promise that she would have a son.  He explains that teshuvah can literally erase the past – it is like the wrongdoing never happened. When a person is a true yarei shamayim, it inspires that type of teshuvah. When Sarah laughed, she immediately realized her error and regretted it; Sarah immediately did complete teshuvah. “Lo tzachakti” – Sarah was correct in saying that she did not laugh, because her teshuvah erased it -- “ki yarei’ah,” because she was on a level of yiras shamayim that engenders such great teshuvah.

Someone who is “yarei mei’aveiros b’yado” lacks that true yiras shamayim. To the contrary, the obsession with wrongdoing indicates a failure to do full teshuvah and rise above the past.

    The rakh haleivav is fleeing the site out of yir'as ha'onesh, not yir'as hacheit.

    1. Could be, but there is no hechrech to say that's what Rashi means. I would feel better about it if Rashi had said yarei m'onesh.

    2. Isn't is muchrach? Someone who is afraid of fighting because of sin is afraid that he may be punished for that sin while in the maqom sakanah that is war. No?

      The same explanation - that slichos is a hakdama to the tfillos of the yom - was given by the Rav, as recorded in Harerei Kedem siman 2.

    3. I assume you mean the Brisker Rov. In which case, yes, I'm told that they lifted a lot from הגרי"ד סולובייציק and kashered it by attribution to others. But I still don't know why this would be true. Why would it be a hakdama to tefilla? Especially since many say it every day at Chatzos, not just the first day.
      If I had to explain it, and in light of the shiurim of RYB that I've learned, I would say the following. In general, stam tefilla is a relatively "weak" force. Shemoneh Esrei, on the other hand, which Chazal call "Tefilla," is powerful. Shemoneh Esrei, where you stand in God's presence, is incomparably more effective. If so, one might say that selichos is just a means of preparing you to daven shemoneh esrei with a kavana that reflects what you experienced during selichos. It's a hechsher for an enhanced, a "selichosdikkeh" shemoneh esrei. If so, the maschil svara is certainly good.
      So, what do you think?

    4. I should have spelled out more in the post. I knew this vort of the Rav's, but am not happy with it for a different reason. The M"B quotes views that the one who davens slichos should be the shat"z for the entire day. According to some, he should even be the shat"z for ma'ariv the night before. Even if slichos are a hakdamah to shachris, how does that extend to mincha, or to ma'ariv the night before? That question is what motivated the post.

      Even assuming it is a hakdamah, is there a din or hakpadah that the person who davens pesukei d'zimra should continue as shat"z for the rest of tefilah? I am not aware of such a thing. (Your hesber would help get around this point.)

      Nafka minah from RYBS's chiddush is (I think I heard this b'shem R' Willing and IIRC R' Ovadya has a teshuvah about something similar) if you miss slichos, rather than say them after shacharis it would be better to wait until mincha and say them then as a hakdamah to the next tefilah.

    5. I checked around twenty sefarim of or about Rav Ovadiah on this topic, and while he says it's muttar to say slichos before Mincha (and there isn't a tadir or shaas hadin issue) he also says you can say it whenever you want- later in the morning, or before mincha.

  3. ועדיין צריכין לרב הוטנר, Rosh Hashana 33:3 and :8, where R"H points out that slichos is a unique form of tefilla, completely different from daily tefilla of l'ovdo b'chol l'vav'chem... and the proof of that is that HKB"H had to show Moshe the derech of selichos, and not simply be metzaveh.

    Without quoting the entire ma'amar, which analyzes the reason for this difference, at the end of :8, R"H notes that during ymei hateshuva, we adopt the character of ba'alei teshuva, who have their own approach to tefilla - i.e., selichot. Which is why selichot are designed as a mini-tefilla: ashrei, tachanun, kaddish tiskabel. Based on this, it might be understandable that the shatz for this unique tefilla would be able to carry this uniqueness over into the other tefillos of the day to give them a connection to the teshuva tefilla.

    I would like to suggest a corollary: The normal concept of shliach tzibur is one who is motzei those who do not know the tefilla, or to lead the kedusha parts of tefilla. But when HKB"H appeared as a shliach tzibur wrapped in a tallis and said the yud gimmel middos, this was an entirely different concept. The shliach tzibbur of selichot is not just a facilitator, but rather the central part of selichot, as an interlocutor. Which would explain the uniqueness of hineni he'ani mi'ma'as to yomim nora'im.

    This shliach tzibbur is categorically different that the conventional shatz. By acting as a shatz for the other tefilla/os, he brings this madreiga with him. His chazaras ha'shatz is no longer a minhag retained from the days of people who didn't know how to doven, or for cases of sofek in tefilla, but is an actually different tefilla than it is on non-selichos days.

      But I don't see how you bring proof from nis'ateif that the shaliach is not functioning as a facilitator for those that do not know how to do it themselves

    2. Because the was presenting the shliach tzibbur as a critical part of the process of slichos before there was even a mitzva of normasl tefilla on the tzibbur. Even when the chiyuv tefilla of the tzibbur [bayis rishon] was subsumed in the korbonos, there still had to be this process for slichos.

      [The facilitator part may still exist - if it is even necessary].

      This would be analogous to the Kohen Gadol being the interlocutor for klal yisroel on Yom Hakippurim.

      Or the ma'aseh with R'Eliezer and R'Akiva who were yored lifnai hataiva during a famine.

      Indeed, it is inherent in the name shliach tzibbur, not just someone who happens to know the nusach.

The dinim of who to appoint as shatz in general, and on the yamim nora'im, is just to inspire the tzibbur, not because he has a din interlocutor. Ay, Hinneni? So you have a kashe. But I am so right that any kashe you ask is shver on the raya, not on me.
